and anyone else it may concern

For clarification purposes, and for the sake of good order, and for any avoidance of doubt, and to be put on record, this statement should make our position clear.

At the end of December 2000 the Zeemax dealership with SMS Motorsport who also trades as Stephens Motorsport was terminated and he should no longer be holding himself/themselves out to be affiliated with Zeemax or its products whatsoever, wheresoever.

 It has come to our notice that:
It would appear that SMS has sold far more Zeemax body kits/parts than has been supplied to him., thus bringing into question the authenticity of the parts that he has been selling. Theft of intellectual property is big business these days, that main looser being the customer who has paid over the odds only to receive fake goods.

It has come to our knowledge that SMS is now giving full cash refunds on body conversions that he has supplied to customers, who suspected that the goods were not, perhaps, genuine parts. However, customers are requested to sign a disclaimer of sorts.

We note that SMS sells other makes of body kits. Are the manufacturers of those other conversions having the same difficulty we are having?

We note that on page 69 of BMW Power Magazine Spring 2001 edition, a silver BMW marked Zeemax, that screws have been used on the outside of the side sills to attach them to the car. Under no circumstance should screws be used on genuine Zeemax parts for attachment of the side sills.

We also note in the advert of SMS on page 59 of BMW Magazine Spring 2001 edition, the vent on the rear bumper spoiler of the 850i has not been cut out. The 850i rear bumper spoilers that we supply, the vent is cut out.

We have had pictures of so called Zeemax conversions purchased in the US emailed to us and are horrified to see the appalling, damaged goods that customers have been receiving. We cannot confirm that the parts are genuine Zeemax parts, but looking at the pictures they certainly look like very bad copies, probably made by a moron.

We have also seen pictures of our cars and conversions that we have carried out being used on other peoples websites and they are claiming our conversions to be their own. They are not.

Whilst we at Zeemax know that imitation is the best form of flattery,
customers please be assured, there is only one Zeemax
The real one!

All our designs are our own intellectual property and have not been purloined from any other designers, and are not copies of any other designs, unlike those who like to think that they are our competitors.

Our products are of the finest quality and do not need relaminating before fitting to make them fit.
The cheapest is always the dearest in the long run. We credit the intelligence of the public to know that.

Zeemax does not manufacture wheels. Anyone manufacturing wheels with the
Zeemax name or logo on is doing so without our knowledge or consent.

We quote from SMS wheel price list:

"We are currently offering our Zeemax Racing Wheels at low introductory prices. The exclusive wheels are very high quality forged 3 piece wheels made to our specifications"

It is our understanding that SMS is charging some $400. per wheel, when in fact these wheels are available at $80.00. per wheel.

Have these `Zeemax` wheels been crash tested, TUV tested, and do they meet with US safety regulations we wonder?

SMS is using the Zeemax name to sell goods that are nothing to do with us, we have never seen or touched, nor are we liable for these wheels. Anyone buying these wheels and having an accident because of these wheels, has no come back on Zeemax whatsoever.

The word that intrigues us somewhat is our. Exactly who is our, it certainly is not Zeemax. Must be SMS., so cannot be Zeemax, can it? - Simple Logic! SMS seems to have an identity crisis, he seems to think that he is Zeemax, when in fact he most definitely is not.

We value all our customers, everywhere, and in order to make sure that our customers get the genuine article we are happy to deal direct with all customers for any size order.

Packing & carriage costs have to be paid whether goods are purchased in the US or from the U.K. At least buying direct from us the customer is certain that he has purchased a genuine Zeemax product and not a rip off.

We do not see why people in America should pay more for our products than anyone else in the world. We have one price for one world. It is our aim to safeguard our American customers against shoddy goods, false claims, possibly fake and positively overpriced goods, consumer fraud, etc, and thro some light on the truth.

We are not out to defame anybody, but the truth must be pursued and upheld at all times. We owe it to our Customer`s to put the record straight, we are not interested in getting involved in a long-term legal or verbal match. But the facts have to be put before the customers.

Zeemax is one the most exclusive European Car Conversion Designers and would want everyone who has a Zeemax conversion to be fully satisfied with the product. No customer should have received damaged goods.

We regeret that this situation has developed, however all blame must lay with SMS for creating these circumstance through his own dishonest, cunning parasitic actions.
